Definition.
Direct Bill is a provider of various mailing list
hygiene services including: (i) Direct Bill’s
Change of Address which is a change of address service
based on databases which are proprietary to Direct
Bill (“DBCOA”); and (ii) National Change
of Address, NCOA Nixie and Locatable Address Conversion
System processing (hereinafter such services shall
be referenced individually or in collectively as
“NCOA”), which are services provided
under a license granted by the United States Postal
Service (“USPS”) and which, Direct Bill
is a distributor of NCOA services through a USPS
NCOA Licensee.
General.
Any Company request for List Hygiene Services
(change of address processing) shall include NCOA
(where applicable) and DBCOA in accordance with
Section 5 hereof.
Limitations On Use of NCOA Service.
Processing Acknowledgment
Form. Prior to providing NCOA services
to Company, Company must submit to Direct Bill
for its approval procedure with its USPS NCOA
Licensee, an original signed Processing Acknowledgment
Form (“PAF”), which will be provided
by Direct Bill on behalf of its USPS NCOA Licensee.
The foregoing procedure regarding the completion
of the PAF is a USPS requirement.
Individual Look-ups.
All data processed through the USPS certified
NCOA software must meet the USPS defined one
hundred (100) record minimum and cannot be used
for individual look-ups, skip tracing, new mover
list creation or other similar applications.
NCOA Usage.
The USPS certified NCOA service can only be
used for use of updating a mail file. All records
processed through this service must be updated
for purposes of being mailed, and for no other
purpose whatsoever.
NCOA Limitations.
In addition to the obligations specified in Subsection
C above, the NCOA function shall be restricted
as follows (in those instances where change of
address service is being requested):
Mail Oriented
Services. Company shall properly identify
all records submitted to Direct Bill for Direct
Bill Services and Direct Bill Data that are
to be mailed. Company shall ensure that each
batch of records submitted for NCOA processing
contains a minimum of one hundred (100) records.
If the one hundred (100) record minimum is available
for a given batch, both NCOA and DBCOA will
be processed. If the one hundred (100) record
minimum is not available for a given batch,
only the DBCOA process shall be employed for
that batch not meeting the minimum one hundred
(100) record requirement.
Non-Mail Oriented
Services. Records submitted to Direct
Bill for Direct Bill Services and Direct Bill
Data used for Company’s non-mail purposes
should be properly identified as such. Non-mail
records are strictly prohibited from utilizing
the NCOA function. All requests for change of
address for non-mail records shall be processed
through DBCOA only in such instances.
Advertising and Marketing.
As a distributor of NCOA services, Direct Bill is
responsible for monitoring and approval of all marketing
material, disbursed by Company that mentions NCOA
service. All material must be reviewed by Direct
Bill’s USPS NCOA Licensee (through Direct
Bill) and subsequently approved by the USPS prior
to distribution. This process may take as long as
forty-five (45) days in some cases.
